Onboarding

Sint Maarten obligations require certain things to be established before we can take on work. Setting them out here means nothing arrives as a surprise.

The four steps
Step 01

Book the Position Review

Engagement begins with the review. Once it is booked, a secure intake link is issued to you directly. Declarations are never collected through this website or by email.

Step 02

Complete three declarations

Politically exposed person status, source of the funds involved, and ultimate beneficial ownership of any entity in scope. The intake saves as you go, so it can be completed at your own pace.

Multiple shareholders. Each shareholder completes their own declarations first, then the beneficial ownership form is completed for the entity collectively.
Step 03

Provide supporting documents

A valid identity document. Where an entity is involved, the articles of incorporation and a current Chamber of Commerce extract. Documents are uploaded through the same secure intake.

Step 04

Engagement letter

Once the documentation is reviewed and accepted, an engagement letter is issued setting out scope, fee and terms. Work begins when it is signed.

What each declaration establishes
How your information is handled

Declarations and documents are submitted through a secure intake, held with access limited to those working on your matter, and retained for the period we are required to keep them. Nothing is shared outside the engagement without your instruction or a legal obligation to do so.

We will never ask for a password, a private key, or credentials to any account. If a message appearing to come from us asks for any of those, it did not come from us.

Common questions
Why is this required?
Sint Maarten obligations require us to establish client identity, the origin of the assets involved and the ultimate beneficial ownership of any entity in scope before we take on work. These are regulatory requirements rather than internal preference.
What is a politically exposed person?
Broadly, someone who holds or has held a prominent public function, together with their immediate family members and close associates. Being one is not an obstacle to engagement. It changes the checks we are required to perform, which is why it is asked at the outset.
What counts as evidence of source of funds?
It depends on the origin. Sale proceeds, employment income, business distributions and inheritance are each evidenced differently. We tell you what is needed for your situation rather than issuing a generic list.
What if an entity has several shareholders?
Each shareholder completes their own declarations, and the beneficial ownership form is then completed for the entity collectively. We coordinate this so it does not fall to you to chase.
How is my information held?
Securely, with access limited to those working on your matter, retained for the period we are required to keep it, and not shared outside the engagement without your instruction or a legal obligation.
How long does onboarding take?
Usually days rather than weeks, and the binding constraint is normally how quickly the supporting documents can be gathered. The declarations themselves can be completed at your own pace and saved part way through.
